By using our site or placing an order with FitMotion.co, you agree to be bound by the following terms. Please read them carefully. If you do not agree with any of these Terms, you should discontinue use of our website.
1. Acceptance of Terms
By accessing or using the FitMotion.co website (the “Site”) and/or purchasing a product from us, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. If you are making a purchase, you represent that you are at least the age of majority in your country or state/province of residence, and legally capable of entering into a binding contract. If you are using the Site on behalf of an organization, you agree to these Terms on behalf of that organization. Do not use this Site if you do not agree with any part of these Terms.
2. Products and Orders
When you place an order on our Site, you are making an offer to purchase the product(s) in your cart. All orders are subject to acceptance by FitMotion.co. We reserve the right to refuse or cancel any order for any reason at our discretion. For example, we may cancel an order if the product is out of stock, if there was an error in pricing, or if we suspect fraudulent or unauthorized activity. If we cancel your order, we will notify you and ensure that you are refunded in fullfor any amount charged. We also reserve the right to limit quantities per order or per customer, such as in cases of limited-edition items or to prevent reselling. In the event of any changes or issues with your order (such as availability or delays), we will contact you via the email address or phone number provided with your order.
Customer Information: You agree to provide current, complete, and accurate purchase and account information for all orders made at our store. You are responsible for ensuring that your shipping address, email, and payment details are correct. FitMotion.co is not responsible for orders not delivered due to incorrect information provided by the customer (e.g. wrong address). Please double-check all details before confirming your order. If you realize you made an error in your information, contact us immediately – we will do our best to help update the order if it has not yet been shipped.
3. Pricing and Availability
All prices displayed on our website are in New Zealand Dollars (NZD) (unless stated otherwise) and include any GST or sales tax as applicable by law. Prices are subject to change without notice, but any such changes will not affect an order that has already been placed. We strive to ensure that all product descriptions, images, and pricing details are accurate. However, errors can occur. In the event that a product is listed at an incorrect price or with incorrect information due to a typographical error or an error in pricing/data received from our suppliers, we reserve the right to correct the error. If you have already ordered the item, we will contact you with the correct information. You will have the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you, or if we receive no response, we may treat the order as cancelled and issue a full refund. Product availability is not guaranteed – stock levels can change quickly especially for popular items. We will inform you as soon as possible if products you ordered are unavailable or delayed, and we will offer a substitute or refund if appropriate.
4. Shipping and Delivery
When you place an order, it will be processed and shipped according to our Shipping Policy. We will deliver the goods to the address you provide. FitMotion.co is not liable for delays in delivery once the package is in transit with the carrier, but we will assist in tracking and resolving any delivery issues. Any delivery dates provided are estimates and not guaranteed. That said, most orders arrive within the timeframes stated in our Shipping Policy, and we make every effort to meet those estimates. Please note that delivery times may be longer for remote areas or due to unforeseen delays (weather, customs clearance, etc.).
Title to and risk of loss of the products will pass to you upon delivery (i.e., when the order is marked as delivered by the carrier). If a package is lost in transit (undelivered), our Refunds and Return Policy (above) will apply – we will replace or refund your order as needed, so you won’t be out of pocket for lost items. For international shipments (outside of New Zealand), as mentioned in our Shipping Policy, you are responsible for any import duties or taxes that may be assessed by your local customs. We have no control over these charges and they are not included in our product prices or shipping fees.
5. Returns and Refunds
By shopping with FitMotion.co, you agree to our Refunds and Return Policy . In summary, we will provide remedies (refunds or replacements) in cases where the product is defective, damaged, incorrect, or lostin transit, in accordance with our policy and relevant laws. However, we do not accept returns or offer refunds for change-of-mind purchases or buyer’s remorse if the product delivered is as described. Please review our full policy (above) for details on how we handle various scenarios. We are committed to compliance with the New Zealand Consumer Guarantees Act, meaning we will ensure you receive goods that are of acceptable quality and match their description, or we will make it right. If you have any issues with a product, please contact us and we will work with you to resolve it as per our policy.

All content on the FitMotion.co website – including but not limited to text descriptions, product images, graphics, logos, videos, and design elements – is the property of FitMotion.co or our content suppliers and is protected by copyright, trademark, and other intellectual property laws. FitMotion and its logo are trademarks of our company. You are not permitted to use our intellectual property (such as our name, logos, or content) for any purpose not related to browsing or shopping on our site without our express written permission. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or our products without express permission from us.
